Necessity Defense
The Necessity Defense is a legal principle that allows a person to justify their illegal actions if they were taken to prevent a greater harm. This defense argues that the individual had no reasonable alternative and acted out of an urgent need to protect themselves or others from imminent danger.
In court, the defendant must demonstrate that the harm they avoided was greater than the harm caused by their actions. Common examples include situations where someone breaks into a building to escape a natural disaster or steals food to prevent starvation.
