Uniformed Services Employment and Reemployment Rights Act
The Uniformed Services Employment and Reemployment Rights Act (USERRA) is a federal law that protects the job rights of individuals who voluntarily or involuntarily leave their civilian jobs to serve in the uniformed services. This includes members of the Army, Navy, Air Force, Marine Corps, and Coast Guard, as well as those in the Public Health Service and National Oceanic and Atmospheric Administration. USERRA ensures that these individuals can return to their jobs without losing their seniority, benefits, or pay.
Under USERRA, employers are required to provide reemployment to service members after their military duty, as long as they meet certain criteria, such as giving advance notice of their service and returning to work within a specified time frame. The law also prohibits discrimination against employees based on their military service. This ensures that those who serve the country can do so without jeopardizing their civilian employment rights.
