Negligence is a legal term that refers to the failure to take proper care in doing something, which results in harm or damage to another person. It involves a lack of reasonable action that a typical person would take in similar circumstances. For example, if a driver does not pay attention to the road and causes an accident, they may be considered negligent.
In order to prove negligence, four key elements must be established: duty of care, breach of duty, causation, and damages. Duty of care means that the person had a responsibility to act in a certain way. A breach of duty occurs when that responsibility is not met, leading to an incident that causes damages to another party.
