Undue Influence
Undue Influence occurs when one person takes advantage of their position of power over another, leading to an unfair or improper agreement. This often happens in situations where there is a relationship of trust, such as between a caregiver and a patient, or a lawyer and a client. The influenced party may not fully understand the consequences of their decisions due to the pressure exerted by the more dominant individual.
To prove Undue Influence, it must be shown that the dominant party had a significant influence over the other and that this influence was used to benefit themselves. Courts often look for signs of coercion or manipulation, which can invalidate contracts or agreements made under such circumstances.
