Specific Performance
Specific Performance is a legal remedy in contract law that compels a party to fulfill their obligations as outlined in a contract. This remedy is typically sought when monetary damages are insufficient to remedy the breach, particularly in cases involving unique items, such as real estate or rare collectibles.
Courts may grant Specific Performance when the subject of the contract is unique or when the damages are difficult to quantify. For example, if someone agrees to sell a specific piece of real estate and then refuses to complete the sale, the buyer may seek Specific Performance to enforce the contract and obtain the property.
