Pure Theory of Law
The "Pure Theory of Law," developed by Hans Kelsen, focuses on the law as a system of norms, separate from morality, politics, or social influences. Kelsen argued that law should be studied in its own right, emphasizing its structure and the relationships between legal norms rather than their practical applications or ethical implications.
This theory posits that the validity of law comes from its adherence to a higher norm, known as the Grundnorm or "basic norm." By isolating legal principles from external factors, the Pure Theory of Law aims to provide a clear and objective framework for understanding legal systems.
